Ninth Circuit Affirms No Prejudice Requirement for IAC MTR Where In Absentia Issued

The Ninth Circuit has affirmed that a petitioner seeking reopening based on ineffective assistance of counsel need not establish prejudice when the ineffective assistance resulted in the entry of an in absentia removal order.
