The en banc Fifth Circuit has reversed three district court orders granting habeas relief to non-citizens held without bond hearings under 8 U.S.C. § 1225(b)(2)(A), holding that neither procedural nor substantive due process requires a bond hearing for people detained as "applicants for admission" during removal proceedings. The decision vacates the earlier panel opinion in Sosnava Rodriguez v. Ortega, which had affirmed the habeas grants and required bond hearings on dangerousness and flight risk within 90 days of detention. The court rejected that 90-day rule, and the mandate issued forthwith.
