A divided D.C. Circuit has reversed the denial of a preliminary injunction in a suit brought by twenty-seven Judeo-Christian organizations challenging DHS's rescission of the 2021 Mayorkas Memo, which limited immigration enforcement at sensitive locations including houses of worship. The district court had found the plaintiffs likely lacked Article III standing. The court addressed only associational standing based on imminent enforcement and applied the Supreme Court's "credible threat" standard, holding that the threat was not speculative because enforcement had already occurred near the plaintiffs' congregations and the government had announced plans to increase it. The majority found the injury traceable to the rescission and likely redressable, since reinstating the memo would restrict enforcement at houses of worship and a judicial-warrant requirement would add procedural hurdle to such enforcement.
